Consumer Terms and Conditions
www.TextACab.net is a service offered by Text A Cab, LLC to provide a service to facilitate, expedite, and enhance the process of ordering ground transportation. We allow our users to reserve or hail a taxi, cab, black car and executive car service, tow truck, shuttle, special transportation, and other ground transportation options. Users can order transportation via the website, SMS, phone, email, and Instant Messenger.
Definitions
- WE / US / OUR - Indicates a reference to Text A Cab, LLC
- YOU / YOUR - Indicates a reference to You, Your Traveling Party, and any persons associated with your request.
- SUPPLIER - Indicates a reference to the supplying Provider of Transportation.
Other definitions will be defined as and when they are used.
WE reserve the right to alter or amend these terms and conditions at any time. YOU have 3 Days in which to raise an objection to the amendments. Should WE not receive a reply from YOU then WE will assume YOU have accepted our new Terms and Conditions, and no correspondence will be entered in to.
If YOU do not accept any revisions you must immediately cease all use OUR SERVICE.
- By YOU placing a booking with US, YOU are confirming YOU have read, understand and agree to abide by the following published Terms and Conditions. Please ensure YOU understand them fully prior to making a request.

- By asking US to distribute YOUR booking, YOU are accepting that the terms of this Agreement, which incorporate the information, restrictions and obligations detailed herein. YOU thereby agree to abide to the entire agreement between US and YOU with regard to YOUR booking and your travel arrangements. YOU also consent to our processing personal information about YOU regarding your location or destination. Your use of the service is subject to our Privacy Policy. You agree that you have read our Privacy Policy, and it is reasonable and acceptable to you.
Your acceptance of these Terms is also consent to the information practices in our Privacy Policy.

By confirming a trip, YOU recognize that a booking requires a final payment to be made by YOU to the SUPPLIER, all payments must be made by YOU to the SUPPLIER directly or through your registered online account with US.
By booking YOU also agree and accept to abide by the terms of conditions imposed by the SUPPLIER with whom you elect to deal with.

- YOUR contract with US is subject to the laws and jurisdiction of the laws of Delaware.
- YOU acknowledge and agree that by using our service, YOU are at a minimum of eighteen years old, or have the express permission from a legal guardian to use OUR services.

- WE reserve the right to cancel or change the request made by YOU at any time. We will inform you should such a change take place. By placing a booking, YOU are confirming YOU are accepting this policy, and WE will not be held responsible for claims regarding this policy by YOU against US or our SUPPLIER.
WE reserve the right to refuse or terminate a booking should WE, in our sole discretion, believe a booking has been placed using deceptive or fraudulent means.
YOU have the right to cancel a trip at least 2 hours before the trip. Otherwise, YOU acknowledge to refund the SUPPLIER for incurred transportation and advertising expenses.

- WE will not be held responsible for financial or personal loss to YOU or YOUR group in the event of failures of the Supplier to appear or any other failure of the Supplier such as a vehicular accident or any refusal to honor the agreed upon price by the Supplier is beyond OUR control.
As WE solely act as a distributor of the text requests and information, it is entirely a SUPPLIER decision to refund any monies already paid by YOU. WE are unable to refund any funds.

- WE are unable to guarantee the timely arrival of a car. The Content of the information that we return is intended for information purposes only. Although we exercise reasonable efforts to ensure their quality and accuracy, there might be errors, or the information provided may not be complete, current, or applicable. Further, information provided regarding the service, etc. have been provided to us by the Suplier. We assume no liability or responsibility to SUPPLIER claims on time frames or price quotes that we pass on to YOU.

- The price quoted by SUPPLIER is determined by the information provided by YOU. If you make any change in the information provided to US, including change in the pick-up location, drop-off location, or the addition of any stops en route, SUPPLIER may demand additional payment. WE shall not be responsible for any additional payment due and owing because of any change in the information provided by YOU.
Conduct While Travelling
The SUPPLIER reserves the right to refuse to accept YOU as a customer or continue dealing with YOU if YOU or YOUR group behaviour is disruptive, or should any member of YOUR group appear to be under the influence of prohibited (or licensed) substances causing a detrimental effect on YOU or any member of YOUR party.
Use of prohibited substances and smoking in any of SUPPLIER vehicles is banned at all times. Should the drivers become aware of any such transgressions from YOU or YOUR travelling group, the SUPPLIER will reserve the right to cancel with immediate effect and eject all passengers at the first safe place to do so.
Any damage caused to the vehicle by any member of YOUR party shall become the sole responsibility of YOU. Any costs associated with repairs and damage must be paid by YOU.
If YOU have a complaint about YOUR arrangements whilst travelling, YOU must immediately notify the SUPPLIER of the service in question.
Disclaimer of Warranty
WE and the SUPPLIERS make no warranty of any kind regarding the Site, Texts, Products or Services, all of which are provided on an "as is" basis. WE and the SUPPLIERS expressly disclaim any representation or warranty that the Site and Texts will be free from errors, that the Services and other capabilities offered from the Site will be uninterrupted, or that its Content will be accurate, complete or timely. The fact that WE are including or offering any Product or Service on the Site is not an endorsement or a recommendation of the Product or Service.
OTHER THAN THOSE WARRANTIES WHICH, UNDER THE LAWS APPLICABLE TO THESE TERMS, ARE IMPLIED BY LAWS, AND ARE INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION, WE EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS, INCLUDING IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE.
We will use our reasonable commercial efforts to keep our service available on a 24-hour/7-day-a- week basis, subject to necessary scheduled downtime for maintenance, unscheduled maintenance, and system outages. WE cannot promise that access to the Site will be uninterrupted or available at all times. We assume no liability or responsibility for any delay, interruption, or downtime.
Limitation of Liability
Subject to applicable law, use of the Site, Texts and its Content is at your sole risk. Services and Products made available on the Site and Texts are subject to conditions imposed by the SUPPLIERS. SUPPLIERS who furnish products or services through the Site and Texts are independent contractors, and not agents or employees of Text A Cab, LLC.
IN NO EVENT WILL TEXT A CAB, LLC BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, SPECIAL OR OTHER CONSEQUENTIAL DAMAGES FOR ANY USE OF THE SITE OR TEXTS, ANY HYPER LINKED WEB SITE, THE ACTS OR OMISSIONS OF SUPPLIERS WHO FURNISH SERVICES THROUGH THIS SITE, OR THE SERVICES OFFERED BY SUPPLIERS THROUGH THIS SITE, INCLUDING, WITHOUT LIMITATION, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, THAT ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH(I) ANY FAILURE OR DELAY (INCLUDING WITHOUT LIMITATION THE USE OF OR INABILITY TO USE ANY COMPONENT OF THE SITE OR TEXTS FOR BOOKING), OR (II) THE PERFORMANCE OR NON PERFORMANCE BY US OR ANY SUPPLIER, OR (III) ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, EVEN IF TEXTACAB HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES TO SUCH PARTIES OR ANY OTHER PARTY.
Mobile Terms and Conditions
YOU can opt-in and register for the service by texting TAXI to EZCAB (39222). Upon registration, YOU will receive discounts and promotions from US and SUPPLIERS. YOU can include a zip code after the keyword TAXI to receive discounts and promotions from local SUPPLIERS.
YOU can receive nationwide listings by sending a LIST keyword to EZCAB™ (39222). If YOU include a zip code following LIST, WE will send you local listings.
YOU can make a trip request by texting EZCAB™ (39222). Visit www.textacab.net/faq for details on submitting a valid request.
WE do not charge you to participate in the program, however, your wireless service provider may charge for sending and/or receiving SMS messages and air-time and standard messaging charges may apply.
WE will not be liable for any delays in the receipt of any SMS messages connected with this program, as delivery of SMS messages is subject to effective transmission from your wireless service provider/network operator.
Alerts on the short code EZCAB™ (39222) are available on the following carriers: Alltel, AT&T, Boost Mobile, Cellular One Dobson, Cellular South, Cincinnati Bell, Midwest Wireless, Nextel, Sprint, T-Mobile, US Cellular, Verizon Wireless, and Virgin Mobile.
